Terms of Service

1. Acceptance of Terms

By creating an account or using the Trainkaki mobile application (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to use Trainkaki. By creating an account, you confirm you meet this age requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity under your account. You agree to provide accurate information during registration. You may not create an account for anyone other than yourself or use another user's account.

4. User Conduct

When using Trainkaki, you agree not to:

• Harass, threaten, or abuse other users
• Post false, misleading, or fraudulent session listings
• Use the App for any illegal activity
• Impersonate another person or misrepresent your identity
• Collect or scrape other users' data
• Post content that is obscene, hateful, or sexually explicit
• Use session chat for spam, solicitation, or commercial promotion outside the coach marketplace (when available)

Violation of these rules may result in account suspension or termination at our sole discretion, without refund.

5. Sessions Are User-Organized

Trainkaki is a platform that connects users. We do not organize, supervise, or endorse any sessions posted on the App. Session hosts are solely responsible for their sessions, including but not limited to:

• The safety and suitability of the chosen venue
• The nature and intensity of the physical activity
• Verifying the skill levels and fitness of participants
• Compliance with applicable laws and venue rules

Trainkaki is not a party to any agreement or arrangement between users.

6. Assumption of Risk

You acknowledge that physical activities — including but not limited to running, padel, tennis, badminton, football, basketball, cycling, gym workouts, and other sports — carry inherent risks of injury, illness, or death.

By using Trainkaki and participating in any session, you voluntarily assume all risks associated with such activities, whether known or unknown, including risks arising from:

• The condition of venues, equipment, or facilities
• The conduct of other participants
• Your own physical condition and fitness level
• Weather or environmental conditions
• Travel to and from sessions

You are solely responsible for assessing your own fitness and the safety of any activity before participating.

7. Limitation of Liability

To the fullest extent permitted by Singapore law, Trainkaki and its operator(s) shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to:

• Your use of or inability to use the App
• Any session, meetup, or physical activity organized or attended through the App
• Personal injury, illness, property damage, or death resulting from any session or interaction arranged through the App
• The conduct or misconduct of any user, whether online or in person
• Unauthorized access to or alteration of your data
• Any other matter relating to the App

This limitation applies regardless of whether the claim is based on contract, tort (including negligence), strict liability, or any other legal theory, even if Trainkaki has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Trainkaki and its operator(s) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your participation in any session or activity organized through the App
• Any injury, loss, or damage caused by you to another user or third party
• Your violation of any law or the rights of any third party

9. No Warranty

The App is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

10. Third-Party Services

The App integrates with Supabase (database and authentication) and Resend (email delivery). We are not responsible for the availability, security, or practices of these third-party services.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may terminate your account at any time through the App.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the App. Continued use after a change constitutes acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Singapore. Any dispute arising from or relating to these Terms or your use of the App shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be referred to mediation in Singapore before resorting to litigation. Both parties submit to the exclusive jurisdiction of the courts of Singapore.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trainkaki regarding your use of the App.
